DMCA Policy
Last updated: August 6, 2024
Magurabike respects the intellectual property rights of others and expects users of its platform to do the same. This Digital Millennium Copyright Act Policy outlines how magurabike responds to claims of copyright infringement and how rights holders may submit a valid notice.
1. Notification of Claimed Infringement
If you believe that content available on or through our platform infringes one or more of your copyrights, you may submit a written notification to our designated copyright agent. To be effective, your notification must include all of the following:
- A physical or electronic signature of a person authorised to act on behalf of the owner of the exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material on the platform.
- Information reasonably sufficient to permit us to contact you, such as your name, address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorised to act on behalf of the owner of the exclusive right that is allegedly infringed.
2. Designated Copyright Agent
Notices of claimed copyright infringement should be directed to our designated agent using the following contact information:
Ashford, Co. Wicklow, A67 XV22, Ireland
Email: contact@magurabike.com
Phone: +353 1 849 3010
We strongly recommend submitting notices by email to ensure timely receipt and processing.
3. Counter-Notification
If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our designated copyright agent. To be effective, your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of a court in the location where you reside, and that you will accept service of process from the person who provided the original infringement notification.
Upon receipt of a valid counter-notification, we may restore the removed material within ten to fourteen business days unless the original complaining party files a court action seeking to restrain the allegedly infringing activity.
4. Repeat Infringers
Magurabike maintains a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. A user may be considered a repeat infringer if they have been the subject of more than one valid DMCA takedown notice or if they repeatedly upload or distribute content in violation of applicable copyright law.
5. Accommodation of Standard Technical Measures
Magurabike accommodates and does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, provided that such measures do not impose substantial costs on the platform or substantial burdens on its systems.
6. Disclaimer of Liability
Magurabike acts as a service provider and is not liable for any infringing content posted by users. We respond to properly submitted notices in accordance with applicable law. Submission of a false or fraudulent DMCA notice may expose the submitting party to liability for damages, including costs and legal fees.
7. Changes to This Policy
We reserve the right to update or modify this DMCA Policy at any time. Changes will become effective upon posting to our platform. Continued use of the platform following any such changes constitutes your acceptance of the revised policy.
